2.1 The conditions referred to in the premise are an integral and substantial part of this contract.
2.2 The contract between Iluna Group S.R.L. and the customer (that is, a natural person/company that purchases the goods) (hereinafter "Customer") must be understood as concluded with the acceptance, even partial, of the order by Iluna Group S.R.L.. By placing an order in the various ways provided, the Customer sends to Iluna an order PROPOSAL and declares that he has read all the information provided to him during the purchase procedure, and to accept in full the general and payment conditions set out below.
2.3 The Customer, once the online purchase procedure is completed, by clicking on the button "SEND ORDER PROPOSAL" will accept the terms and conditions of sale in this contract, and will authorize Iluna Group S.R.L., at the time of sending the goods purchased, the charge of the total amount indicated, including the contribution for shipping costs.
3.1 The Customer may only purchase the Products listed in the electronic catalogue of the shop.iluna.com website at the time of placing the order proposal, as described in the relevant information sheets. It is understood that the image accompanying the descriptive card of a product may not be perfectly representative of its characteristics but differ in color, size, products accessories present in the figure. All the information supporting the purchase are intended as simple generic information material, not related to the real characteristics of a single product, which are instead described in the technical information. Sales prices are not inclusive of VAT. Iluna assumes no responsibility for any color differences between the photos shown on the Internet and the goods delivered for this purpose it is recommended to proceed with the order of samples. Variations in color and tolerance of use with reference to data sheet, between the samples delivered and the goods delivered are always possible and do not constitute any defect.
3.2 The correct receipt of the order proposal is confirmed by Iluna Group S.R.L. by an automatic reply via e-mail, sent to the email address communicated by the Customer. This confirmation message will contain the date and time of receipt of the order proposal.
The order proposal will then be processed by Iluna according to the needs of the customer and the production/ warehouse needs of Iluna. At the end of the processing process Iluna will send the Customer an email confirming the order processed indicating the order number and payment terms.
3.3 In case of non-acceptance of the order proposal, Iluna Group S.R.L. guarantees communication to the Customer by e-mail or phone within 5 working days from receipt of the summary e-mail. Iluna Group S.R.L. accepts orders for Products within the limits of the quantities in stock. Therefore, the acceptance of the purchase proposal by Iluna Group S.R.L. is subject to the stock availability of the Products themselves. Iluna Group S.R.L. undertakes to promptly communicate to the Customer any unforeseeable depletion of stocks due to excess demand or other causes. It is expressly excluded any right of the Customer to compensation for damages or indemnity, and in any case excluded any liability of Iluna Group S.R.L., contractual or non-contractual, for direct or indirect damages to persons and/or property, caused by the non-acceptance, even partial, of an order. If the customer wants to proceed with a production order, in the absence of availability, Iluna Group S.R.L. will communicate the delivery time.
The Customer declares to be of legal age, as well as that the data provided by it are correct and truthful.
The Customer is prohibited from entering false and/or invented and/or fictitious data in the registration procedure for the execution of this contract and for the related communications. It is expressly forbidden to make double registrations or enter third-party data.
The Customer will however keep Iluna Group S.R.L. indemnified from any liability, charge or cost directly/indirectly connected or consequent from:
incorrect or third-party data input;
Customer’s use of the shop.iluna.com website;
use of the customer’s access credentials by third parties;
Customer breaches of these General Terms and Conditions of Sale.
Iluna reserves, at its sole discretion, the right to erase the credentials or registration of users for incorrect, abnormal or otherwise non-compliant behaviour to the commercial police of Iluna.
The payment must include the order number and must be made, unless otherwise agreed, by bank transfer made to Iluna Group S.R.L. at:

The customer can proceed with the payment, by credit card or bank transfer, after receiving the order confirmation from Iluna. At no time during the purchase procedure Iluna Group S.R.L. is able to know the financial information of the Customer. As there is no data transmission, there is no possibility that this data will be intercepted. No computer archive of Iluna Group S.R.L. contains, stores, such data. For each transaction executed with the Bank Transfer the Customer will receive a confirmation email.
6.1 Insert the general conditions of sale Iluna as order confirmation
7.1 Iluna Group S.R.L. delivers the products by courier and/or trusted carriers within 72 working hours from the credit of the payment made by the customer. Delivery times for products that must undergo processing will be defined from time to time by Iluna and before the order confirmation. The delivery times are indicative and are in no way binding for Iluna Group S.R.L. and in any case will not exceed 30 days in case of goods available for prompt delivery. No liability can be attributed to Iluna Group S.R.L. in case of delay in the fulfilment of the order or delivery of what ordered.
7.2 For each order placed on the shop.iluna.com.it site, Iluna Group S.R.L. issues a document accompanying the material shipped. For the issue of the invoice, the information provided by the Customer at the time of the order is authentic. After the issue of the invoice it will not be possible to make variations of the same.
7.3 The delivery costs, if any, are borne by the Customer and are clearly stated when the order confirmation is made.
7.4 Deliveries by courier are made in WORKING HOURS therefore it is preferable to enter an address at which someone is always present for collection, otherwise the parcel will go into storage with consequent delay in delivery and possible charge of custody costs.
7.5 The delivery of the order is intended to the ground floor. At the time of delivery of the Products the Customer must check:
- that the number of packages delivered to him corresponds to what is indicated in the transport document;
- that the packaging is intact and not altered even in the closing tapes.
In case of tampering and/or breakage, the Customer must immediately contest the shipment and/or delivery by placing the written "goods control reserve" on the delivery document received from the courier or other operator. Subsequently, you must report any damage within 3 (three) days of receipt of the Products in the manner provided by the operator chosen for the shipment and/or delivery and/or the operator. In the event of failure by the customer to collect within 5 (five) working days, the products ordered and present in stock at the warehouses of the courier, Iluna Group S.R.L. will cancel the purchase order due to the impossibility of delivery of the Products at the address indicated by the Customer at the time of the order, with charge to the latter of the costs of storage/ storage of the Products.

Iluna Group S.R.L. declines all responsibility for failure to deliver arising from causes dependent on failure to withdraw, incorrect address or entered in a incomplete or other causes not dependent on its own action or omission. In any case it is always possible to request the cancellation of the order as indicated in the following paragraphs.

Iluna Group S.R.L. does not assume any responsibility for disruptions due to force majeure such as fires, earthquakes, strikes and/ or lockouts, floods and other similar events that prevented, in whole or in part, to execute in the time agreed to this contract. Iluna Group S.R.L. will not be liable to the Customer or third parties for damages, costs or losses suffered as a result of the failure to perform this contract for the reasons mentioned above, the Customer has the right only to return any price already paid.
The personal data requested at the time of placing the order are collected and processed in order to meet the express requests of the Customer. Iluna Group S.R.L. guarantees to its customers compliance with the legislation on the processing of personal data, governed by the aforementioned Privacy Code. This contract is concluded in Italy and is governed by Italian law. For the settlement of disputes arising from the conclusion of this contract, the territorial jurisdiction is exclusively that of the Court of Bergamo.
